The labels and instructions of infant and young children formula milk powder products shall not contain vague information or expressions such as "ecological pasture" and "breastfeeding". On July 10, the State Administration for Market Regulation issued a newly revised Administration Measures on Formula Registration of Infant and Young Children Formula Milk Powder Products, which will take effect from October 1, 2023.
In order to ensure the quality and safety of infant and young children formula milk powder and further strengthen the strict supervision of the formula registration process, the newly revised Measures stipulates the application and registration procedures, labels and instructions, supervision and management and legal responsibilities for enterprises that intend to produce, sell and import infant and young children formula milk powder in China. The Administration Measures on Formula Registration of Infant and Young Children Formula Milk Powder Products issued by the former State Food and Drug Administration on June 6, 2016 was repealed at the same time.
In terms of further regulating the labeling and identification, the Measures clarified that if the product name has the words of animal origin, the raw milk, milk powder, whey powder and other milk protein sources should all come from the specie; it is prohibited to mark false, exaggerated, contrary to scientific principles or absolute content. At the same time, it is clear that the label and instruction shall not contain 9 situations, and it is added that vague information such as "imported milk source", "from foreign pastures", "ecological pastures", "imported raw materials", "original ecological milk source" and "pollution-free milk source" shall not be used; "human emulsification", "breastfeeding" or similar terms shall not be used; other contents that does not comply with the provisions of laws, regulations, rules and national food safety standards shall not be used, and listed the situations that express or imply health care effect.
In terms of strict formula registration, the Measures clearly prohibit disguised subpackaging (using compound ingredients that have met the nutritional composition requirements of the national food safety standard for infant and young children formula as raw materials to apply for formula registration) and 8 deny of registration situations. On-site verification of the formula registration of infant and young children formula milk powder products is an important part of the product formula pre-market registration review, the Measures clarified the situations and requirements that need to be carried out on-site verification, and emphasized that on-site verification requires the dynamically produced samples for inspection.
The Measures increased the penalties for acts of bad nature that cause harmful consequences, and adjusted the upper limit of fines for harmful consequences caused by applicants obtaining registration certificates by cheating, bribery and other improper means, and forging, altering, reselling, renting, lending and transferring formula registration certificates of infant and young children formula milk powder products to 200,000 Yuan.
